Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and PixelFly ("Company," "we," "us," or "our"). By accessing or using the PixelFly server-side tracking platform and the website located at pixelfly.io (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to any portion of these Terms, you must not access the Service.

Description of Service

PixelFly enables users to send server-side conversion events to advertising platforms including Meta Conversions API (CAPI), Google Analytics 4, TikTok Events API, and LinkedIn Conversions API. The Service is provided on an "as is" and "as available" basis. We strive to ensure compatibility with current versions of major e-commerce platforms and popular integrations, but we do not guarantee the platform will work with every setup. If conflict, we will assist to fix. Features may change over time as we improve the product.

Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current and complete information during registration and to update such information as needed. You are responsible for safeguarding your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

License & Acceptable Use

Subject to your compliance with these Terms, PixelFly grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You may: Use the Service to track events from websites you own or manage, configure integrations with supported platforms, access analytics features, and use our API per documentation.

You may not: Resell or redistribute the Service, reverse engineer any part of it, transmit malware, attempt unauthorized access, track websites without authorization, use it for illegal purposes, or send fraudulent event data.

Subscription & Payment

We offer various subscription plans with different features and event limits. Details are available on our pricing page. Subscription fees are billed in advance monthly or annually. All fees are in Bangladeshi Taka (BDT) or US Dollars (USD). Payment can be made via bKash, Nagad, or credit/debit card. Subscriptions auto-renew unless cancelled.

We may modify pricing with 30 days notice. All fees exclude applicable taxes, which you are responsible for.

Cancellation & Refunds

You may cancel your subscription anytime from your dashboard. Your access continues until the billing period ends. No further charges after cancellation. Data is retained 30 days post-closure, then deleted.

Data & Privacy

Your use of the Service is governed by our Privacy Policy.

When using PixelFly, you are responsible for ensuring proper consent to collect user data, complying with data protection laws (GDPR, CCPA, etc.), providing privacy notices to visitors, and configuring the Service per platform policies. PixelFly acts as a data processor, processing event data solely to forward to your configured platforms.

Intellectual Property

The Service, including all content, features, software, and documentation, is owned by PixelFly and protected by intellectual property laws. You retain ownership of data you submit; by using the Service, you grant us a limited license to process it for providing the Service.

Third-Party Services

The Service integrates with Meta, Google, TikTok, LinkedIn, WooCommerce, Shopify, and others. Your use of these integrations is subject to their respective terms. PixelFly is not responsible for third-party service availability, API changes, or data processing once events are delivered.

Service Availability

We strive for high availability but do not guarantee uninterrupted operation. Maintenance will be communicated in advance when possible. Support is provided via email at support@pixelfly.io.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant the Service will meet your requirements, be uninterrupted, secure, or error-free, or that results will be accurate.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELFLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless PixelFly from any claims, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights or laws.

Termination

You may terminate anytime by cancelling and requesting account deletion. We may suspend or terminate access if you breach these Terms, pose a security risk, or as required by law. Upon termination, your right to use the Service ceases immediately.

Changes to Terms

We may modify these Terms with 30 days notice for material changes. Continued use after changes constitutes acceptance.

General Provisions

These Terms constitute the entire agreement between you and PixelFly. If any provision is unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without consent. These Terms are governed by the laws of Bangladesh.
